TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of the Carolina Totes LLC website, services, products, and rental equipment. By accessing our website, placing an order, creating a reservation, accepting delivery of rental equipment, or using our services, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use our website or services.

1. ELIGIBILITY

To use our services, you must:

• Be at least eighteen (18) years old

• Be legally capable of entering into binding agreements

• Provide accurate and complete information

• Be the authorized holder or authorized user of the payment method used for the reservation

Carolina Totes reserves the right to refuse service, cancel reservations, or terminate access to services at its sole discretion.

1. SERVICES PROVIDED

Carolina Totes provides reusable moving tote rentals and related moving equipment, including but not limited to:

• Moving totes

• Moving dollies

• Moving blankets

• Rental accessories

Service availability may vary based on inventory, location, scheduling, weather conditions, and operational requirements.

1. RESERVATIONS

Reservations are subject to equipment availability.

A reservation is not guaranteed until payment has been successfully processed and confirmation has been issued by Carolina Totes.

Customers are responsible for ensuring all reservation information is accurate, including:

• Name

• Address

• Phone number

• Email address

• Delivery date

• Pickup date

Carolina Totes is not responsible for delays or issues caused by inaccurate information provided by the customer.

1. PAYMENT

Full payment is required at the time of reservation unless otherwise stated.

By submitting payment, Customer authorizes Carolina Totes to process charges related to the reservation and any amounts due under the Rental Agreement.

Accepted payment methods may include major credit cards, debit cards, and other payment methods offered through our website.

1. RENTAL AGREEMENT

All rentals are governed by the Carolina Totes Rental Agreement.

By placing a reservation, Customer agrees to execute any required Rental Agreement and comply with all rental terms.

In the event of any conflict between these Terms and the Rental Agreement, the Rental Agreement shall control regarding rental equipment, fees, damages, and customer responsibilities.

1. DELIVERY AND PICKUP

Delivery and pickup services are provided according to the reservation selected by the Customer.

Customer is responsible for ensuring:

• Accurate delivery information

• Safe access to the delivery location

• Safe access to the pickup location

• Equipment availability for scheduled pickup

Additional fees may apply for missed deliveries, missed pickups, inaccessible equipment, or rescheduling.

1. RENTAL EQUIPMENT

All rental equipment remains the property of Carolina Totes LLC.

Customers are responsible for protecting rental equipment from:

• Theft

• Loss

• Misuse

• Excessive damage

• Unauthorized use

Customers may not sell, transfer, sublease, modify, or dispose of rental equipment.

1. FEES AND ADDITIONAL CHARGES

Customer may be charged for:

• Rental extensions

• Missed pickups

• Redeliveries

• Cleaning fees

• Damage charges

• Replacement costs

• Unpaid balances

Fees and replacement costs are detailed in the Rental Agreement.

1. REFUNDS AND CANCELLATIONS

Refunds and cancellations are governed by the Carolina Totes Refund & Cancellation Policy.

By placing a reservation, Customer acknowledges and agrees to that policy.

No refunds will be issued except as specifically provided in the Refund & Cancellation Policy.

1. PHOTO DOCUMENTATION

Customer acknowledges that Carolina Totes may photograph rental equipment, delivery locations, pickup locations, and damaged equipment for operational, documentation, security, insurance, collection, dispute resolution, and legal purposes.

Such photographs may be used to verify compliance with rental obligations.

1. PAYMENT DISPUTES

Customer agrees to contact Carolina Totes and make a good-faith effort to resolve any billing issue before initiating a chargeback, payment reversal, bank dispute, or similar claim.

Carolina Totes maintains records including:

• Reservation details

• Payment records

• Electronic signatures

• Acceptance records

• Delivery records

• Pickup records

• Photographs

• Customer communications

Such records may be used in responding to payment disputes or chargebacks.

1. INTELLECTUAL PROPERTY

All content on the Carolina Totes website, including logos, text, graphics, photographs, designs, trademarks, and branding, is the property of Carolina Totes LLC and may not be copied, reproduced, distributed, or used without written permission.

1. CUSTOMER REVIEWS AND SUBMISSIONS

By submitting reviews, testimonials, photographs, comments, suggestions, or other content to Carolina Totes, Customer grants Carolina Totes a non-exclusive, royalty-free, perpetual license to use, reproduce, modify, publish, display, and distribute such content for marketing, advertising, promotional, and business purposes.

Customer represents that they have the right to submit such content.

1. MARKETING PHOTOGRAPHY

Customer grants Carolina Totes permission to use photographs and videos taken during delivery, pickup, or other service-related activities for marketing, promotional, advertising, website, and social media purposes, provided such use does not intentionally disclose sensitive personal information.

Customers may request removal of identifiable images by contacting Carolina Totes, although Carolina Totes reserves the right to retain photographs for business, legal, operational, or recordkeeping purposes.

1. DISCLAIMER OF WARRANTIES

Services and rental equipment are provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, Carolina Totes disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

1. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Carolina Totes LLC shall not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages arising from use of the website, services, or rental equipment.

Carolina Totes' total liability shall not exceed the amount paid by Customer for the specific reservation giving rise to the claim.

1. INDEMNIFICATION

Customer agrees to indemnify, defend, and hold harmless Carolina Totes LLC and its owners, members, employees, contractors, representatives, and affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from:

• Customer's use of services

• Customer's use of rental equipment

• Customer's violation of these Terms

• Customer's violation of any law

1. GOVERNING LAW

These Terms shall be governed by and interpreted under the laws of the State of North Carolina without regard to conflict of law principles.

1. VENUE

Any legal action or proceeding arising from these Terms or the use of Carolina Totes services shall be brought exclusively in the courts located in Brunswick County, North Carolina.

Customer consents to the jurisdiction of such courts.

1. CHANGES TO THESE TERMS

Carolina Totes reserves the right to update, modify, or replace these Terms at any time.

Updated versions will be posted on our website with a revised effective date.

Continued use of our services after changes are posted constitutes acceptance of the revised Terms.

1. SEVERABILITY

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

1. ENTIRE AGREEMENT

These Terms, together with the Rental Agreement, Refund & Cancellation Policy, and Privacy Policy, constitute the entire agreement between Customer and Carolina Totes regarding use of our website, services, and rental equipment.
